Texas Sues Meta Over WhatsApp Encryption Claims

Texas Attorney General Ken Paxton filed a lawsuit on May 21 against Meta and WhatsApp, accusing the companies of misleading 3.3 billion users about message privacy. The complaint alleges WhatsApp falsely represented that messages were protected by end-to-end encryption while Meta personnel could actually access private communications on demand.
The allegations stem partly from a federal Commerce Department investigation that was abruptly closed earlier this year. An agency investigator wrote in a memo that there was "no limit" to the type of WhatsApp messages Meta could view, according to Bloomberg. Texas is seeking civil penalties of up to $10,000 per violation and a permanent injunction preventing Meta from accessing Texans' communications without consent under the Texas Deceptive Trade Practices Act.
Meta denied the claims, with a spokesperson stating "WhatsApp cannot access people's encrypted communications and any suggestion to the contrary is false." This follows Meta's $1.4 billion settlement with Texas last year over facial recognition data collection allegations, signaling escalating privacy-focused regulatory pressure on major tech platforms.
For businesses relying on WhatsApp for sensitive communications, these allegations challenge fundamental trust in encrypted messaging platforms.
