A federal appeals court in DC has ruled that the Pentagon can continue to blacklist Anthropic, upholding a Trump administration decision. The court found the Department of Defense had "ample support" for concluding that integrating Anthropic's Claude AI into its systems presented a national security risk. This decision stems from Anthropic's refusal to allow the government to deploy its AI models for autonomous weapons or domestic surveillance, a stance Secretary of Defense Pete Hegseth deemed a significant national security risk.

Anthropic had challenged two separate supply-chain risk designations. While a federal judge in San Francisco tossed out one designation, Friday's ruling ensures the other remains in place indefinitely, allowing the Pentagon to continue blocking Anthropic. The company is considering further appeals, potentially to a broader panel of the DC Circuit Court of Appeals or the US Supreme Court. Anthropic previously stated it lost revenue due to customer concerns following the initial designations.

The court rejected Anthropic's claims of due process and free speech violations, stating the government followed procedure and the dispute was standard contract negotiations. This ruling allows the Pentagon to continue avoiding Claude ahead of Anthropic's potential IPO. Meanwhile, the Pentagon has not provided detailed updates on replacing Claude with alternatives like SpaceX’s Grok, Google’s Gemini, or OpenAI’s GPT models, despite ethical concerns raised by some employees at Google and OpenAI regarding military contracts.
