Meta's New Terms Spark AI Data Scraping Concerns

Meta's new business terms, effective October 30th, raise concerns about AI training data.

Insta's take

"Meta's new rules? They're basically giving themselves a free pass to hoover up your website data for AI. Pay to post links, then they scrape it for free. Wild."

Meta's updated commercial terms, set to take effect on October 30th, appear to grant the company permission to crawl and scrape websites associated with businesses using its platforms, including online publishers. This development has sparked alarm among content creators and legal experts, who suggest Meta could use this content to train its AI products. The terms specify that Meta can use automated software to access, index, and analyze domains and web pages linked to products or services, or made available through the use of Meta Company Products.

Legal experts, as reported by Nieman Lab, indicate that these new terms could allow Meta to bypass existing blocking instructions, such as a site's robots.txt file, potentially avoiding millions in AI licensing fees. While a Meta spokesperson stated that the company is merely consolidating commercial and self-serve ad terms and that content owners can still use robots.txt flags, critics argue this grants Meta broad access to content for AI training. The policy applies to business accounts promoting content across Facebook, Instagram, WhatsApp, and Messenger.

This move follows Meta's previous AI licensing deals with entities like CNN and Fox News, but the new terms could provide access to a much wider array of content. Businesses that do not agree to these updated policies may face restrictions on their use of Meta's products for commercial purposes. Nieman Lab also noted that Meta has begun charging users for links in posts and reels, suggesting the company will crawl this same content for free.

Why Insta thinks this matters

Business owners and content creators using Meta's platforms should review these new terms carefully, as they could impact how their website content is used for AI training. This change may affect intellectual property rights and potentially lead to Meta using content without direct licensing, impacting revenue streams for publishers.
